Bar Associations in Turkey in the 1980-1991 Period: A Case Study on the Interface Between the State and Civil Societal Groups

The present study focuses upon bar associations -professional associations set up by attorneys, dating back to the late Ottoman era- in Turkey during the 1980-1991 period. While conducting an analysis concerning the developments in attorneyship as a branch of the legal profession and attorneys' socio-political role in the Turkish political process, the bar associations are examined from the view point of the critical issue of the relationship between the state and civil societal groups. The judicio-legal sphere has been taken as the main interface between the two actors. It has been concluded that the state-bar association relationships during the 1980-1991 period evinced a basic struggle. Such a conflict was especially manifest during periods of politicization of the legal system. The analysis shows that the unique position of the Turkish state vis-àvis civil society, its dominance in the judicio-legal sphere, and the degree of institutionalization of the bar associations were the main determinants of the nature of the relationship in question.
