21. yüzyıla girdiğimiz bu tarihsel dönemde, içinde bulunduğumuz dünya koşullan uluslararası hukuk paradigmasını da derinden etkilemekte ve karşılıklılık ilkesine göre değil, ortak yarar esası üzerine şekillenmesine yol açmaktadır. Westphalia sistemine dayalı geleneksel hukuk anlayışının irdelendiği bu noktada, uluslararası hukukun buyruk kuralları sorununun da -jus cogens-yeniden ele alınmasının anlamlı olacağı kanaatindeyiz Devletlerin uygulamalarına ve mahkeme kararlarına sınırlı ölçüde yansımış olan jus cogens kavramı esas olarak andlaşmalar hukuku çerçevesinde gündeme gelmiştir. Uluslararası andlaşmalar hukukunun kodifikasyonuna yönelik olarak Uluslararası Hukuk Komisyonu'ndaki çalışmalar ile 1969 Viyana Andlaşmalar Hukuku Sözleşmesi'nin kabulü ile sonuçlanan konferans müzakereleri sırasında, jus cogens uluslararası hukuk teorisi ve devletlerin yaklaşımları bakımından geniş kapsamlı ve ayrıntılı bir şekilde ele alınmıştır. Jus çöğensin devletlerin tek taraflı eylem ve işlemleri üzerindeki etkisi bakımından gerek doktrinde, gerekse uygulamada aynı yoğunlukta bir ilginin mevcut olduğunu ileri sürmek mümkün görünmemektedir.
