Contract management starts with the contract negotiations and lasts until the end of the contract, and is the process that covers three fundamental functions required to compensate the goals of the project; Relationship Management, Project Delivery, and Administration of the contract. This thesis focused on investigating contract management behavior of Turkish construction companies in international projects. A survey was composed and interviewed with professionals for investigating the contract management behavior of contractors. The survey aimed to investigate; factors influencing contractors’ behaviors, key success factors for contract management, company contract management organizations, claim issues, and conflict and dispute resolution behavior of firms. 51 companies participated to the survey. The survey results revealed that Turkish contractors consider contract management to be significant for success at international markets. Contractors are aware of the need for a continuous contract management application although this rate cannot be achieved in practice. Considering awareness as a driving factor for improvement it can be estimated that in future Turkish contractors will be managing their contracts in more efficient, organized and systematic ways than today. Results revealed that; contract management behaviors are mostly affected by the risk and complexity of the project, regular contract process is the most impactful process on the success, and change order requests of the owners are the most frequent reasons of claims. According to respondents contract management can reduce number of conflicts and disputes.

Multipurpose semantic analysis of construction text documentation
Candaş, Ali Bedii; Tokdemir, Onur Behzat; Department of Civil Engineering (2022-8)
Construction contracts are crucial documents as they outline the agreement. In case any vagueness is present in contract sentences, the interpretation of the sentences will vary between different parties of the contract. Such a case would cause a dispute and eventually adversely affect the construction project's success. Additionally, multiple parties that sign the contract and various departments/disciplines within a party need to be aware of the content of these contracts. All these departments review and...
Comparison of international federation of consulting engineers and general specification for public works contracts from risk management perspective
Usta, Ergun; Birgönül, Mustafa Talat; Department of Civil Engineering (2005)
Contractors have to construct the projects efficiently in accordance with the contract provisions when they accept a contract. All construction projects involve risk and there is no possibility to eliminate all the risks associated with a specific project. Management of risk requires identification and analysis of risk factors. After this risk assessment step, proper response strategies have to be developed so that an optimum risk-reward structure is ensured. Contracts are the grounds where risk allocation ...
Improving sub-contractor selection process in construction projects: Web-based sub-contractor evaluation system (WEBSES)
Arslan, Gokhan; Kivrak, Serkan; Birgönül, Mustafa Talat; Dikmen Toker, İrem (Elsevier BV, 2008-05-01)
One of the most important phases in the construction industry (CI) is the bidding process. During the bidding process, selecting the most appropriate sub-contractors (SCs) for the relevant sub-works is highly critical for the overall project performance. In order to select the most appropriate SCs for the project and prepare the most realistic and accurate bid proposal, general contractors (GCs) have to know all financial, technical and general information about these SCs. Within this context, GCs should co...
Integrated Approach to Overcome Shortcomings in Current Delay Analysis Practices
Birgönül, Mustafa Talat; Dikmen Toker, İrem (American Society of Civil Engineers (ASCE), 2015-04-01)
Many factors, such as unforeseeable events, managerial and financial problems of contractors, insufficient technical capacity of site teams of contractors or Consultants, and so on, may lead to delays in construction projects. Proper analysis of compensability and quantum of a delay event is of prime importance. Any delay analysis application can be considered as a result of the combination of contract documents, scheduler, record-keeping mechanism at the site, communication among project participants, dela...
