Günümüzde enerji sorunu ve bu sorun çerçevesinde enerji sektörü global ekonomi gündeminin temel parçalarından birini oluşturmaktadır. Türkiye ekonomisi için de enerji sektörü, enerji piyasası ve bu piyasanın düzenlenmesi/idaresi ekonominin temel gündem maddeleri arasındadır. Bu çalışma, 1980-sonrası dönemde, Türkiye’de enerji sektörünün yapılandırma sürecindeki yasal düzenlemelerin, (devlet)-piyasa ilişkilerinin inşası çerçevesinde bir değerlendirmesini sunmayı amaçlamaktadır. 1980-sonrası neoliberal dönemde şekillenen iktisat politikalarının kısa değerlendirmesi altında, bu politikaların enerji sektörüne ve enerji piyasalarına (elektrik sektörü özelinde) yansımaları, bu dönemde gerçekleştirilen yasal düzenlemeler ile birlikte ele alınmaktadır. Böylece, bu düzenlemelerin katkıda bulunduğu üretim ilişkilerinin işleyişinin (yeniden) yapılandırılması sürecine ve sürecin elektrik sektöründe üretim, iletim, dağıtım ve ticaret faaliyetlerine, piyasasının yapısına ve bu çerçevede ekonomiye ve ‘refahın dağılımına’ etkilerine değinmek mümkün olmaktadır.

This study intends to provide an overview of the legislations framing the re-structuring of the Turkish energy (in particular electricity) sector and markets in the post-1980 period. The period, of course describes the neo-liberal transition of a developing economy and can roughly be analyzed in two sub-periods: The first period, 1980-2000, dominated by the principles of `Washington Consensus`, is mainly characterized by a gradual opening up of the economy towards full integration with the world commodity and financial markets. The post-2001 era is the second phase of the neoliberal restructuring of the Turkish economy, this time shaped in line with the `Post-Washington Consensus`: good governance through strong market-regulating institutions as well as consumer protection and competition regulation. Such restructuring has shaped the economic policy making as well as the legislation framework under which these policies operate.
