Bölge olarak adlandırılan derin deniz yatağı, İnsanlığın Ortak Mirası (İOM) olarak kabul edilmiş, burada bulunan maden kaynaklarının yönetimi, Uluslararası Deniz Yatağı Otoritesi’ne (UDYO) verilmiştir. Bu çalışmada, öncelikle İOM kavramının sömürge yönetimlerinden kurtulan toplumlar açısından önemi ve deniz hukukuna etkisi incelenmekte; ikinci olarak bu kavramın uygulamaya aktarılmasında başlıca sorumluluğu olan UDYO’nun yetkileri ele alınmaktadır. Bölge’deki madencilik faaliyetlerinde tüm devletler, ‘destekleyen devlet’ olarak yer alabilmekte, ancak altına girilecek hukuki sorumluluğun sınırının yeterince belirgin olmaması, teknik ve mali yönden elverşsiz olan devletler üzerinde caydırıcı etki yapmaktadır. Çalışmada, İOM kavramını olumsuz yönde etkileyen bu durumla ilgili olarak, Uluslararası Deniz Hukuku Mahkemesi’nin 2011 yılında verdiği Danışma Görüşü değerlendirilmektedir.
