In this study, the origin and main parameters of the Essential Facilities Doctrine are analysed through the case-law that developed out of the application of the EC Competition Rules. Besides putting forward the historical roots, the basic criteria and limitations that apply to the Doctrine are elaborated so as to clarify the legal and analytical foundations of the Doctrine in the EU context. In addition, the added value attributed to the Doctrine in realm of competition policies pursued in network-based industries is expounded with special emphasis on telecommunications sectors. With this regard, the potential role of EFD against the challenging effects of ءconvergence̕ phenomenon and the technological changes is discussed. At last, the effects of EFD on the competitive dynamics of Turkish telecommunications sector which is undergoing a liberalisation process are also examined with the accompanied Turkish case-law.

Political economy of labour law in Turkey : work employment and international division of labour
Özdemir, Ali Murat; Yalman, Osman Galip; Department of Political Science and Public Administration (2004)
This thesis aims to evaluate the Turkish Labour Law on the basis of a new approach to legal studies that follow the internal tendency of legal science to resolve its own problem, which is that of convincingly defining the point of contact between norm and fact (form and content), materially connecting the juridical organisation of power with the social structuring of power, while avoiding both formalist and positivist deviations. Against this background, the thesis aims to assess the correlation between the...
Gas-kinetic methods for 3-d inviscid and viscous flow solutions on unstructured/hybrid grids
Ilgaz, Murat; Tuncer, İsmail Hakkı; Department of Aerospace Engineering (2007)
In this thesis, gas-kinetic methods for inviscid and viscous flow simulations are developed. Initially, the finite volume gas-kinetic methods are investigated for 1-D flows as a preliminary study and are discussed in detail from theoretical and numerical points of view. The preliminary results show that the gas-kinetic methods do not produce any unphysical flow phenomena. Especially the Gas-Kinetic BGK method, which takes into account the particle collisions, predicts compressible flows accurately. The Gas-...
Harmonisation in european union on industrial property rights protection procedures : effects on Turkey within the framework of customs union
Demirdağ, Serap; Aşçıoğlu Öz, Gamze; Department of European Studies (2004)
This thesis aims at answering two questions under the topic of Harmonisation of Industrial Property Rights Protection Procedures in the European Union. The questions researched are: أWhat are the current systems of Industrial Property Rights protection in the world, in the European Union and Turkey?ؤ and أIs there a way for Turkey to be included within the EU Industrial Property protection system in the future while still being under the relation of Customs Union?ؤ. To answer these questions current systems...
Design optimization in chemically reacting flows
Yumuşak, M.; Eyi, Sinan (2011-12-01)
The objective of this study is to develop a reliable and efficient design tool that can be used in chemically reacting flows. The flow analysis is based on axisymmetric Euler and the finite rate chemical reaction equations. These coupled equations are solved by using Newton's method. Both numerical and analytical methods are used to calculate Jacobian matrices. Sensitivities are evaluated by using adjoint method. The performance of the optimization method is demonstrated for a rocket motor nozzle design. © ...
ON ROBUSTNESS OF CONCURRENT LEARNING ADAPTIVE CONTROL TO TIME-VARYING DISTURBANCES AND SYSTEM UNCERTAINTIES
Sarsilmaz, S. Burak; Kutay, Ali Türker; Yucelen, Tansel (2017-11-09)
In this paper, we study the robustness characteristics of a recently developed concurrent learning model reference adaptive control approach to time-varying disturbances and system uncertainties. Specifically, the commonly-used constant (or slowly time-varying) assumption on disturbances and system uncertainties for this particular adaptive control approach is replaced with its bounded counterpart with piecewise continuous and bounded derivatives. Based on the Lyapunov's direct method, we then show that the...
