Arbitration is an increasingly popular alternative form of resolution for construction disputes. After the establishment of the Istanbul Arbitration Center, the question of whether international parties would prefer it instead of other popular venues has arisen. Previous studies have found that the reasons for preferring one seat of arbitration over others are strongly related to judicial attitudes toward arbitration and the legal infrastructure. Therefore, the aim of this paper is to compare the Turkish legal infrastructure and judicial attitudes with those of England and Singapore, the leading and most improved seats of arbitration, respectively. For this purpose, the relevant decisions of Turkish courts and legislative provisions were analyzed and a comparative study was carried out. It was found that by incorporating the Model Law and signing the New York Convention, Turkey has leaped forward. Moreover, Turkish courts have supported arbitration proceedings even if the arbitration seat was outside Turkey. However, Turkish courts are criticized in two respects: (1) finality of arbitral awards were sacrificed in return for procedural perfection; and (2) an appropriate balance was not struck between parties' right to have the award enforced and the public good. Capacity planning and range setting quantity flexibility contracts as a manufacturer
Pesen, Şafak; Kayalıgil, Sinan; Department of Industrial Engineering (2003)
Quantity Flexibility contract is an arrangement where parties agree upon a scheme of forming ranges on volumes for their future transactions. The contract is based on setting upper and lower limits on replenishment orders as simple multiples of point estimates updated, published and committed by the buyers. We introduce a manufacturer with a limited capacity; also capable of subcontracting, for deliveries with a known lead time. He offers a Quantity Flexibility (QF) contract to a buyer while he has an activ...
Using fuzzy risk assessment to rate cost overrun risk in international construction projects
Dikmen Toker, İrem; Birgönül, Mustafa Talat (Elsevier BV, 2007-07-01)
Determination of an appropriate mark-up while bidding for international construction projects is a critical decision. Level of mark-up is a function of risks associated with a project. Construction companies may benefit from a tool that helps them to assess the level of risk so that they can determine an appropriate mark-up. The aim of this paper is to propose a fuzzy risk assessment methodology for international construction projects and develop a tool to implement the proposed methodology. The proposed me...

Pro business local governance and local business associations The case of Gaziantep
Bayırbağ, Mustafa Kemal (2011-01-01)
The article investigates how major changes in national economic policies, and in associated forms of state-business relations, produce pro-business local governance arrangements. It places the emphasis on the politics of state-business relations that revolve around the distribution of public resources. It aims to explain, in particular, how these dynamics unfold in the developing countries where neoliberal reforms are implemented under conditions of political instability and weak policy capacity of the stat...
Comparison of international federation of consulting engineers and general specification for public works contracts from risk management perspective
Usta, Ergun; Birgönül, Mustafa Talat; Department of Civil Engineering (2005)
Contractors have to construct the projects efficiently in accordance with the contract provisions when they accept a contract. All construction projects involve risk and there is no possibility to eliminate all the risks associated with a specific project. Management of risk requires identification and analysis of risk factors. After this risk assessment step, proper response strategies have to be developed so that an optimum risk-reward structure is ensured. Contracts are the grounds where risk allocation ...
